Terms & Conditions Policy
These Terms & Conditions (“Terms”) constitute a legally binding agreement between Mixkin Private Limited, operating under the brand name Lakshyant (“Company”, “Lakshyant”, “we”, “us”, “our”), and any person (“User”, “Student”, “you”, “your”) who accesses, registers for, enrolls in, or uses any services offered by Lakshyant through its website, mobile application, learning management system (LMS), physical/offline centers, or any other medium (collectively, the “Platform”).
By accessing or using the Platform, you irrevocably agree to be bound by these Terms, the Disclaimer, Refund & Cancellation Policy, Privacy Policy, and all rules, notices, and guidelines issued by Lakshyant from time to time.
If you do not agree, you must immediately discontinue use of the Platform.
- Scope of Services
Lakshyant provides online, offline, and hybrid coaching services, including but not limited to live classes, recorded lectures, digital study material, assessments, mentoring, and academic or career guidance. All services are provided on a best-effort basis and strictly for educational purposes only.
- No Agency / No Affiliation
Lakshyant is a private coaching institution. It is not affiliated with, endorsed by, or acting on behalf of any government authority, examination body, university, board, or recruiting agency unless expressly stated in writing.
- Eligibility & Legal Capacity
You represent and warrant that: You are legally competent to enter into a binding contract under Indian law, or
You are enrolling with the express consent and supervision of a parent or legal guardian (for minors)
Lakshyant shall not be liable for false representations regarding age or authority.
- Registration & Account Security
Access to online services may require account registration.
You are solely responsible for all activity conducted through your account.
Sharing login credentials, content, or access with any third party is strictly prohibited.
Lakshyant reserves the right to suspend or permanently terminate accounts without notice for violations.
- Fees, Payments & Taxes
All fees are payable as communicated at the time of enrollment.
Fees may be revised at Lakshyant’s sole discretion.
Fees may include applicable taxes unless stated otherwise.
Failure to pay fees or installments on time may result in suspension or termination of services without refund.
- Refunds & Cancellations
All refunds, cancellations, withdrawals, and fee-related matters are governed exclusively by Lakshyant’s Refund & Cancellation Policy, which forms an integral and binding part of these Terms.
No verbal assurances or representations shall override the written policy.
- Strict No Guarantee Clause
Lakshyant expressly disclaims any guarantee, warranty, or assurance regarding:
Examination performance, Ranks, scores, or admissions, Certifications or placements, Career, income, or professional outcomes
All outcomes depend on individual effort, aptitude, discipline, and external factors beyond Lakshyant’s control.
- Intellectual Property Rights
All content, material, systems, software, and branding on the Platform are the exclusive intellectual property of Mixkin Private Limited.
Users shall not:
Copy, reproduce, distribute, transmit, sell, or modify any content, Record live classes or sessions, Upload content to third-party platforms, Use content for commercial or competitive purposes
Violation may result in civil and criminal action under applicable laws.
- Offline Coaching Conduct
For offline programs: Students must comply with all institutional rules and codes of conduct. Lakshyant reserves the right to suspend or expel students for misconduct, indiscipline, or disruption. No refund shall be issued in such cases.
- Platform Availability & Technical Disclaimer
Lakshyant does not guarantee uninterrupted or error-free access to the Platform. Services may be affected by maintenance, upgrades, technical issues, force majeure events, or third-party failures. Lakshyant shall not be liable for any loss arising from such disruptions.
- Third-Party Services
Lakshyant may integrate third-party services (including payment gateways). Lakshyant does not control and assumes no liability for the acts, omissions, or policies of such third parties.
- Suspension & Termination
Lakshyant reserves the unrestricted right to suspend or terminate access to any user, without notice or refund, for: Breach of these Terms, Misuse of content, Fraudulent activity, Abusive, unlawful, or disruptive behavior.
- Limitation of Liability
To the maximum extent permitted by law:
Lakshyant and Mixkin Private Limited shall not be liable for any indirect, incidental, special, or consequential damages.
Total liability, if any, shall not exceed the amount paid by the user for the specific service in dispute.
- 14. Indemnity
You agree to indemnify and hold harmless Mixkin Private Limited, Lakshyant, its directors, employees, and affiliates from any claims, losses, damages, liabilities, or expenses arising out of: Your use of the Platform, Violation of these Terms, Infringement of any third-party rights.
- Modification of Terms
Lakshyant reserves the right to modify these Terms at any time without prior notice. Continued use of the Platform constitutes acceptance of the revised Terms.
- 16. Governing Law & Jurisdiction
These Terms shall be governed by the laws of India. Any disputes related to these Terms will be resolved in the courts of Bhubaneswar Jurisdiction.
- Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
- Acceptance
By accessing or using the Lakshyant website, app, LMS, or offline services, you acknowledge that you have read, understood, and legally agreed to be bound by these Terms & Conditions.
- User-Generated Content
If you submit content, such as reviews, feedback, or comments, you grant us a non-exclusive, worldwide, royalty-free license to use, modify, and display that content in connection with our business.
- Intellectual Property
All content on our website and App, including text, images, logos, graphics, and software, is the property of Mixkin Private Limited or its licensors and is protected by copyright and intellectual property laws.
You may not use, reproduce, or distribute any content from our website or App without our written consent.
- Communications
When you visit our website / App or send e-mails to us, you are communicating with us electronically. You will be required to provide a valid phone number while placing an order with us. We may communicate with you by e-mail, SMS, phone call or by posting notices on the website or by any other mode of communication. For contractual purposes, you consent to receive communications including SMS, e-mail or phone calls from us with respect to your order.
- Taxes
You shall be responsible for payment of all fees / costs / charges associated with the purchase of products/services on the website and you agree to bear all applicable taxes, cesses etc. levied thereon. You are responsible to ensure that (if applicable) you are registered under applicable taxation laws and will update your correct tax registration details on our website / App. We will not be liable in case tax credits are denied to you under taxation laws due to reasons attributable to you. You hereby acknowledge and agree that we shall not revise Invoices. You will reverse tax credit availed if any on the returned product and undertake to disclose the details of credit note while reporting for your taxes. Further, you agree to indemnify and hold harmless us for all losses, liability incurred by us on account of your action or inaction in compliance with the applicable laws.
